These Terms of Service (the "Terms") set out the conditions for using the Kikeruka app (the "App"). We ask that you ("the user") agree to these Terms before using the App.
The App provides a service that scans a book's ISBN barcode and checks whether that book is available as an audiobook. The App displays information from audiobook services such as Audible and audiobook.jp, but does not itself provide those services.
The App can be used without registering an account.
3.1 Every feature of the App is free to use. There are no in-app purchases.
3.2 All features, including audiobook release notifications, are available at no additional charge.
3.3 The App displays advertisements. There is currently no way to hide them.
The user must not do any of the following:
4.1 Anything that violates laws or public order and morals
4.2 Anything connected with criminal activity
4.3 Destroying or interfering with the functioning of the App's servers or network
4.4 Anything that risks interfering with the operation of the App
4.5 Collecting or accumulating personal information about other users
4.6 Gaining or attempting to gain unauthorised access
4.7 Impersonating another user
4.8 Directly or indirectly providing benefit to antisocial forces in connection with the App
4.9 Anything else we judge to be inappropriate
5.1 We may suspend or interrupt all or part of the App without giving the user prior notice where we judge that any of the following applies:
(1) Where maintenance, inspection or updating of the computer systems behind the App is carried out
(2) Where providing the App becomes difficult because of force majeure such as earthquake, lightning, fire, power failure or natural disaster
(3) Where computers or communication lines stop because of an accident
(4) Where we otherwise judge that providing the App is difficult
5.2 We accept no liability whatsoever for any disadvantage or damage suffered by the user or a third party as a result of the App being suspended or interrupted.
6.1 The user may use the App to post or edit only text, images, video and other information for which the user holds the necessary intellectual property rights, including copyright, or for which the user has obtained permission from the rights holder.
6.2 Copyright in the text, images, video and so on that a user posts or edits using the App remains with that user or with the existing rights holder.
7.1 We make no warranty, express or implied, that the App is free from defects in fact or in law (including defects, errors, bugs or infringements relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose or security).
7.2 We accept no liability for any damage arising to the user out of the App, except where caused by our wilful misconduct or gross negligence.
7.3 We accept no liability for any transaction, communication or dispute arising between a user and another user or a third party in connection with the App.
We may change the contents of the App or discontinue providing it without notifying the user, and accept no liability for any damage arising to the user as a result.
We may change these Terms at any time without notifying the user where we judge it necessary. Where a user begins using the App after a change to these Terms, that user is deemed to have agreed to the amended Terms.
Notices and communications between us and the user shall be made by the method we specify. Unless the user submits a change of details in the manner we separately prescribe, we shall treat the contact details currently registered as valid and send notices or communications to them, and these shall be deemed to have reached the user at the time of sending.
Without our prior written consent, the user may not assign to a third party, or offer as security, their position under the usage agreement or any right or obligation under these Terms.
12.1 These Terms shall be interpreted under the laws of Japan.
12.2 Where a dispute arises in connection with the App, the court with jurisdiction over the location of our head office shall have exclusive jurisdiction by agreement.
